Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Der gebundene AN ist hauptvertraglich mit der Generalplanung für den Neubau des Empfangsgebäudes am Hauptbahnhof

München in den Lph. 1-4 beauftragt. Die Abgabe des Entwurfsheftes für die Lph. 3 erfolgte am 09.09.2022. Fehlende

Planungsgrundlagen im Vorfeld der eigentlichen Entwurfsphase, zusätzliche Aufgabenstellungen während der laufenden

Entwurfsplanung (nach Abschluss der agilen Phase in der EP), sowie neue Prämissen für bereits fertig entworfene

Planungsthemen führten zu zwingend notwendigen Anpassungen im bereits übermittelten Entwurfsheft. Die Vielzahl an

Änderungen (im Nachgang zur

Abgabe des Entwurfshefts Lph 3 am 09.09.2022) führte zu einer Konsolidierungsphase, in Folge derer eine Konsolidierungsliste

mit allen notwendigen Anpassungen entwickelt wurde, die notwendig sind, um die EP qualitätsgerecht abschließen zu können.

Die Umsetzung bzw. Abarbeitung der Planungstehmen aus dieser Liste ist nunmehr Gegenstand der vorliegenden

Leistungsänderung.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

In der Konsolidierungsphase werden Planungsthemen bearbeitet, die weder in der ursprünglichen Aufgabenstellung enthalten

sind, noch im Rahmen der sogenannten agilen Phase zu Beginn der EP in den Planungsprozess eingesteuert werden konnten.

Sämtliche Änderungen greifen daher direkt mit den hauptvertraglichen Leistungen ineinander, weshalb ein Auftrennen auf

mehrere AN nicht möglich ist. Der bereits gebundene Generalplaner schuldet eine gesamthafte und in sich konsistente

Entwurfsplanung, die er nur gewährleisten kann, wenn er selbst die entsprechenden Anpassungen aus der Konsolidierungsphase

vornimmt.

Über die gesamte Bandbreite der Planung hinweg entstehen eng verzahnte Überarbeitungen einzelner Planungsanteile, die

wiederum auch innerhalb der unterschiedlichen Gewerke verknüpft sind (Tragwerks-, Objektplanung, TGA, etc.). Ein Herauslösen

bzw. Überarbeiten einzelner Bausteine, wirkt sich stets auf das Gesamtsystem aus.
