Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Die Leistung wurde zum Zeitpunkt der Ausschreibung nach bestem Wissen und gewissen geplant. Enthalten sind das Bestandsmodell der bestehenden Eisenbahnverkehrsanlagen. Weiterhin soll im Zuge der Leistung die Auswirkung der notwendigen Durchlässe auf bestehende Bauwerke und Zwangspunkte geprüft werden, dies ist eine Anforderung für den Nachweis der Abflußquerschnitte.

Im Zuge der weiteren Planungen hat sich nach Sicht des AN ergeben, dass die Bestansmodellierung der Bauwertke und die dadurch resultierende Dimoensionierung zwingend für eine tragfähige und funktionale Planung notwendig sind. Durch die Planungsmethode BIM sind nur so die Auswirkungen auf die Kosten- und Bauzeitschätzung vorhanden. Diese Leistung wird generalistisch vom AN geschuldet.

Aus diesem Ereignis ergibt sich die Notwendig, die Modellierung des Bestandes der Durchlässe und die Planung der Durchlässe in dem Planungsgebiet durch die Ingenieurgemeinschaft durchführen zu lasse. LÄ 6 Blau-Grün Durchlässe

Eine Vergleichbarkeit der zu erwartenden Baukosten ist nur dann Aussagekräftig wenn die Planungen in sich konsistent sind. Dies wird gewährleistet, da die Planungen vom gleichen Personal erbracht werden.

Die Auswirkungen bei dem ständigen Austausch und anpassungen der jeweiligen Planung würde zur erheblichen Kosten und Terminlichen problemen führen. Im Zuge der Modellierung mit der BIM-Methodik aus einer Hand ist hier die Auswirkung sofort erkennbar und Anpassungen sind leicht möglich im interativen Prozess was eine in sich konsitente Planung mit sich bringt.
