II.2.4)Description of the procurement at the time of conclusion of the contract:

Die Maßnahme "Rückbau Laborflächen zu Bürobereichen" umfasst Fachplanungsleistungen zum Leistungsbild Technische Ausrüstung für die Anlagengruppen 1, 2, 4 und 5 gemäß § 53 Abs. 2 HOAI. Mit Zuschlagserteilung werden zunächst die Leistungsphasen 1 bis 8 beauftragt (Sufe 1). Die Beauftragung der Leistungsphase 9 ist als Stufe 2 vorgesehen.

Die Maßnahme "Behebung sicherheitsrelevanter Mängel" umfasst Fachplanungsleistungen zum Leistungsbild Technische Ausrüstung für die Anlagengruppen 1, 2, 3, 4, 5, 7 und 8 gemäß § 53 Abs. 2 HOAI. Als Stufe 1 werden zunächst die Leistungsphasen 1 bis 3 beauftragt. Vorgesehen sind folgende weitere Stufen:

- 2. Stufe: Leistungsphase 4 (nur Anlagengruppe 3);

- 3. Stufe: Leistungsphasen 5 bis 8;

- 4. Stufe: Leistungsphase 9.

Ein Rechtsanspruch auf Weiterbeauftragung aller Stufen/Leistungsphasen besteht nicht.

Die bereits erstellte ganzheitliche Kostenberechnung muss nachträglich auf einzelne Bauabschnitte aufgeteilt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Aufsplittung der Kostenberechnung in einzelne Bauabschnitte ist aufgrund nachträglicher Vorgaben des Fördergebers erforderlich geworden. Diese Leistung muss aus planerischen und technischen Gründen zwingend im weiteren Planungsverlauf bei der Fachplanung TGA angegliedert werden, da diese Leistung sowohl terminlich als auch gewerketechnisch direkt mit der gesamten TGA-Planung zusammenhängt und daher ausschließlich von dem Planer TGA erbracht werden kann.

Eine Ausschreibung dieser Planerleistung und ein damit verbundener möglicher Wechsel des Auftragnehmers nur für diese Leistung ist auf Grund der dann nicht mehr ganzheitlichen Planung der TGA technisch nicht möglich, würde außerdem zu Verzögerungen sowohl in der Planung als auch in dem späteren Bauablauf des Gesamtprojektes und somit zu erheblichen Mehrkosten durch unter anderem ein neues Ausschreibungsverfahren, den monatlich steigenden Baupreis und die damit verbundenen höheren anrechenbaren Baukosten führen.

Bei den Wertangaben der Preiserhöhung handelt es sich um fiktive Werte. Auf eine Veröffentlichung der tatsächlichen Werte wird gem. § 39 Abs. 6 VgV verzichtet.
