Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Nachtrag 05: Mit diesem Nachtragsangebot wird der Auf- und Abbau von Lf-Signalisierung, sowie die in den bisher eingereichten Nachträgen noch nicht aufgeführten Feiertags- und Sonntagszuschläge. Für das Bauvorhaben sind weiterhin zusätzliche Sicherungsleistungen notwendig. Für die provisorische Personenüberführung ist es aufgrund von Auflagen notwendig, dass 24 Stunden am Tag Reisendenlenker am Mittelbahnsteig präsent sind.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Es werden über den Nachtrag 4 bereits die zusätzlichen notwendigen Schichten durch die Bauzeitverlängerung angemeldet.

Über den NT5 werden zu den bisher eingereichten Nachträgen noch Zuschläge für Feiertags- und Nachtschichten angemeldet.

Die wirtschaftlichen und technischen Gründe für die Verhinderung des AN-Wechsels bleiben analog des Nachtrags 4 gleich. Ein Wechsel hätte sowohl einen Baustopp auf der Baustelle zur Folge, als auch eine Einstellung des Reisendenverkehrs über den Mittelbahnsteig.
