Die Charité - Universitätsmedizin Berlin, Charitéplatz 1, 10117 Berlin veröffentlicht diese Ex-Ante Transparenzbekanntmachung nach § 135 Abs. 3 GWB. Es wird beabsichtigt, den Auftrag für den Rahmenvertrag über die Lieferung von Maschinenperfusion-Einwegkits für das Gerät XVIVO LiverAssist direkt an das Unternehmen XVIVO B.V., Bornholmstraat 84, 9723 AZ Groningen, The Netherlands zu erteilen.

Gegenstand des Rahmenvertrags soll die Belieferungen von ca. 50 – 70 Kits für das XVIVO LiverAssist Gerät für den ca. 2-jährigen Rekrutierungszeitraum der HOPE-NMP Studie (DFG LU2185/2-1) für die Charité - Universitätsmedizin sowie das Universitätsklinikum Hamburg-Eppendorf sein. Die genaue Anzahl an Kits ist abhängig von der Studienrekrutierung und der Anzahl der eingesetzten XVIVO LiverAssist Geräte an den vorgenannten Studienzentren.

Explanation:

Die Charité – Universitätsmedizin Berlin („Charité“) betreut federführend die multizentrische Maschinenperfusionsstudie HOPE-NMP („HOPE-NMP-Studie“) im Bereich der Lebertransplantation. An dieser Studie nehmen neben der Charité das Universitätsklinikum Münster, das Universitätsklinikum Bonn und das Universitätsklinikum Hamburg-Eppendorf teil.

Im Rahmen der HOPE-NMP-Studie wird der Einsatz ex-vivo Maschinenperfusions-Techniken zur Verbesserung der Organfunktion vor der Lebertransplantation im Vergleich zur konventionellen kalten Lagerung der Spenderorgane untersucht.

Hierbei kommen neuste Perfusionsgeräte zum Einsatz, bei denen für den bedenkenlosen Einsatz der jeweiligen Perfusionstechnik ausschließlich für dieses Gerät hergestellte sterile Einwegmaterialen genutzt werden können. Dies gilt umso mehr, als dass bereits kleinste Kompatibilitätsabweichungen der Einwegmaterialien an den Perfusionsgeräten zu einer Kontamination sowie unsachgemäße Perfusion mit der Folge einer erheblichen Gefährdung der Spendenorgane bis hin zum Verlust des Transplantates führen können.

Darüber hinaus hat die vorherige EU-Markterkundung AL 122/23 (Bekanntmachung: 2023/S 181-567472) ergeben, dass nur das Unternehmen XVIVO B.V. Maschinenperfusion-Einwegkits für das Gerät XVIVO LiverAssist anbietet, welches die in dem Markterkundungsverfahren genannten Anforderungen erfüllen, sodass die Firma XVIVO B.V. der einzige Anbieter am Markt ist.

Vor diesem Hintergrund informiert die Charité im Wege einer Ex-Ante-Transparenzbekanntmachung nach § 135 Abs. 3 GWB über die beabsichtigte Beauftragung des Unternehmens XVIVO B.V. , Bornholmstraat 84, 9723 AZ Groningen, The Netherlands bezüglich des Rahmenvertrags über die Lieferung von Maschinenperfusion-Einwegkits für das Gerät XVIVO LiverAssist an die Studienteilnehmer (s. o.).

Die Beauftragung wird nicht vor Ablauf der in § 135 Abs. 3 Nr. 3 GWB genannten Frist von 10 Tagen nach Veröffentlichung der Bekanntmachung erfolgen.
