Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Prüfung auf direkte Betroffenheit des Zwischensignals auf das Projekt Würzburg-Heidingsfeld West Neue Vst und ob das

Bahnsteigprojekt Verursacher ist. Hintergrund: Im Zuge der ESTW Erstellung Heidingsfeld Ost wurden durch die ausführende

Firma einige Zugfahrstraßen falsch programmiert. Zur Konfliktlösung ist evtl. ein Zwischensignal notwendig. Dies hätte

Auswirkungen auf das Projekt. LÄ03

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund der Überarbeitung der Vorentwurfsplanung bestitzt der AN besondere Kenntnisse über das Projekt. Der Wechsel

des AN würde zu weiteren das Projektziel gefährdenden Schnittstellen und somit Risiken führen. Es würde zusätzlich höhere

Planungskosten auffallen, die unverhältnismäßig sind.
