Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Das Leistungssoll des Auftragnehmers umfasst u. a. die Baustellenlogistik zwischen den zur Verfügung gestellten Logistikgleisen 51 - 55 und dem Baufeld Gleis 5/25/35 und Gleis 6/26.

Durch die Vergabe der zusätzlichen Transportleistungen an den ursprünglichen Auftragnehmer können erhebliche Überschneidungen mit den Logistikleistungen gemäß Bausoll vermieden und in der Folge ein erhöhter Abstimmungsaufwand sowie Verzögerungen im Leistungsablauf verhindert werden.

Der Wechsel des Auftragnehmers und das vorangestellte Vergabeverfahren hätten eine Verzögerung des geplanten Bauablaufes und die Gefährdung der Inbetriebnahmetermine zur Folge.

Im weiteren Verlauf müssten vorhandene Betren verlängert bzw. neue Betren beantragt werden.

Weiterhin müssten die freigegebene PT1-Planungen für die LST-Bauzustände angepasst und wieder in den Prüflauf gegeben werden.
