Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Im Rahmen des Projektes wurden die klassischen Leistungsphasen der HOAI durchlaufen und eine 1:1-Erneuerung der Bautechnik an den Bahnübergängen vorgesehen um die Sicherungsanlagen neu zu bauen.

Wie im Regelwerk gefordert wurden in diesem Zusammenhang Vermessungen der Kreuzungsbereiche, aktualisierte Verkehrszählungen und Verkehrsschauen unter Beteiligungen der verantwortlichen Träger von Bahn und Straße durchgeführt.

Diese Grundlagen flossen soweit in die Ausschreibung ein und sind Bestandteil der vergebenen Leistungen.

Im tieferen Verlauf der Ausführungsplanung und der folgenden fachtechnischen Prüfung der Unterlagen ergaben sich jedoch Auflagen und Änderungen, die bei der Ausschreibung noch nicht bekannt waren, so dass die 1:1-Erneuerung nicht an allen Punkten umgesetzt werden kann. Die auszuführenden Leistungen sind entsprechend anzupassen und zu erweitern.
