         § 130a Abs. 8 SGB V ermöglicht den Krankenkassen (KK) und pharmazeutischen Unternehmen, Rahmenrabattverträge über die zu Lasten der gesetzlichen KK abzugebenden Arzneimittel zu schließen. Die GWQ wird als Gesellschaft für Wirtschaftlichkeit und Qualität bei KK gem. § 130a Abs. 8 S. 5 SGBV für ihre Aktionärs- und Kundenkassen tätig. In Hinblick auf die dafür einschlägigen gesetzlichen Vorschriften zur Vergabe öffentlicher Aufträge, findet ein regelmäßiger Prozess wirkstoffbezogener, förmlicher Vergabeverfahren nach den Regularien des 4. Teils des GWB durch die GWQ ServicePlus AG statt. Bis zum In-Krafttreten neuer Arzneimittelrabattverträge möchte die GWQ mit allen interessierten pharmazeutischen Unternehmen Arzneimittelrabattverträge abschließen. Vertragsstart ist der 01.11.2023

         Die GWQ ServicePlus AG beabsichtigt, nicht-exklusive Rabattvereinbarungen nach § 130a Abs. 8 SGB V zu dem o. a. Wirkstoff zu schließen. Diesem Vertrag können zu jeder Zeit der Vertragslaufzeit alle interessierten Unternehmen zu den gleichen Bedingungen beitreten (Zulassungsmodell).

         Die GWQ geht davon aus, dass dieses Verfahren auf Grund einer fehlenden Auswahlentscheidung und mithin der diskriminierungsfreien Zugangsmöglichkeit aller pharmazeutischen Unternehmen nicht in den Anwendungsbereich des Kartellvergaberechts fällt. Die Vertragsunterlagen, die teilnehmenden Krankenkassen und deren Umsätze sowie die Termine für die Meldung des Vertrags sind auf dem Vergabeportal der GWQ ServicePlus AG unter http://vergabeportal.gwq-serviceplus.de einzusehen und herunterzuladen. Bis zum Start exklusiver Verträge steht diese Übergangsvereinbarung allen Marktteilnehmern zum Beitritt offen.

         Bei Eingang der unterzeichneten Verträge / Erklärung und Nachweise zum 10.10.2023 kann eine erstmalige Meldung zum 01.11.2023 realisiert werden.

         - einen Nachweis über die arzneimittelrechtliche Zulassung mittels Auszug aus dem öffentlichen Teil der AMIce-Datenbank;

         - PZN-Liste (Anlage 4)

         - Erklärung zur Verordnung (Anlage 5)

         - Selbstauskunft „Nachhaltigkeit“ (Anlage 6)
