Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Es sind weitere Planungsstunden, also Mehraufwände, notwendig geworden, weil die Planungsgrundlage, im speziellen die

Bestandspläne, fehlerbehaftet waren und nach der Korrektur diese erneut eingearbeitet werden mussten. Ebenso sind weitere

Bestanfspläne durch Parallelmaßnahmen fortlaufend verändert worden. Da die verschiedenen Maßnahnem auf die gleichen

Plänen planen, musste der Planungsstand der Parallelmaßnahem ebenfalls eingearbeteit werden. So musste

Teilplanungsleistungen wiederholt werden, was als Mehraufwand ausgewiesen wird.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund dessen, dass der Autragnehmer keine zusätzliche Objekte beplanen soll, sondern ausschließlich anteilig die bereits

beauftragten Objekte, wegen fehlerhafter Planungsgrundlage, überarbeiten muss, ist ein Wechsel des Auftrfagnehmers nicht

möglich. Würde es doch erfolgen, so würde eine doppelte Beauftragung vorliegen, was unter allen Umständen zu vermeiden ist.
