         Die Befähigung und Erlaubnis zur Berufsausübung muss anhand des Eintrags in das Berufs- oder Handelsregister erklärt werden oder entsprechend der Regelungen des Staates in dem das Unternehmen niedergelassen ist. Erklärung zur Berufsgenossenschaft ist erforderlich. Die Verpflichtung zur Tariftreue-Mindestlohn nach LTMG-BW (KEV 179.3) muss vollständig erklärt werden.

         Umsatz: Angaben sind zu den letzten drei Jahren erforderlich. Mindestumsatz von 150.000 € pro Jahr. Insolvenz und Liquidation: entsprechende Erklärung ist erforderlich. Erklärungen zum Nichtvorliegen von schweren Verfehlungen ist erforderlich. Erklärung zur Zahlung von Steuern, Abgaben und Beiträgen zur gesetzlichen Sozialversicherung ist erforderlich. Das Vorliegen einer Berufshaftpflichtversicherung für Personen- und sonstige Schäden in Höhe von 1.000.000 € für Personenschäden und 500.000 € für sonstige Schäden je Versicherungsfall für die Dauer des Auftrags, in einem Mitgliedstaat der EU oder eines Vertragsstaates des Abkommens über den Europäischen Wirtschaftsraum zugelassenen Versicherungsunternehmens. Alternativ kann die Erklärung zum Abschluss einer entsprechenden Versicherung abgegeben werden. Dazu muss eine Bescheinigung des Versicherers beigelegt werden, die bestätigt, dass die Versicherung in entsprechender Höhe mit dem Bieter abgeschlossen werden kann.
