         a) Nachforderungen: Der Auftraggeber ist berechtigt, nicht geeignete Bieter vom weiteren Verfahren auszuschließen. Ferner behält sich der Auftraggeber vor, fehlende Unterlagen nachzufordern. Auf § 57 (1) Nr. 2 VgV wird hingewiesen.

         b) Verpflichtung zum Zuschlag, Finanzierungsvorbehalt: Der Auftraggeber ist gem. § 63 (1) S. 2 VgV grundsätzlich nicht verpflichtet, den Zuschlag zu erteilen. Der Zuschlag steht unter dem Vorbehalt, dass die entsprechenden Fördermittel bereitgestellt werden.

         c) Bekanntmachung. Der Auftraggeber gibt bekannt sich vorzubehalten, gem. § 17 (11) VgV ohne in Verhandlungen einzutreten, den Zuschlag auf das wirtschaftlichste Erstangebot gem. den in den Vergabeunterlagen beschriebenen Wertungskriterien zu erteilen u. gem. § 17 (12) VgV die Zahl der Angebote zu verringern.
