Verlängerung der Vertragsfristen durch die Verzögerungen im Bauablauf.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Eine Neuausschreibung wäre im Hinblick einer neuen Baustelleneinrichtung unwirtschaftlich, würde zusätzlich verteuern. Zudem auch nicht zielführend und hätte den ganzen Bauablauf noch zusätzlich verzögert. Es ist keine wesentliche Änderung und der Gesamtcharakter der Leistung ist nicht verändert. Die zusätzlichen Leistungen sind für die vertragsgerechte Ausführung der vergebenen Leistung Gerüstarbeiten DIN 18451 erforderlich.

Gemäß § 132 Abs. 2 Satz 1 Nr. 2 GWB ist es zulässig eine Auftragsänderung ohne neues Vergabeverfahren durchzuführen, da ein zusätzlicher Mehraufwand erforderlich geworden ist und ein Wechsel des Auftragnehmers aus wirtschaftlichen und fachtechnischen Gründen nicht erfolgen kann und mit erheblichen Schwierigkeiten und beträchtlichen Zusatzkosten für den öffentlichen Auftraggeber verbunden wäre.
