Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Gemäß Hauptvertrag sollen durch den BAU-AN die KTB-Maßnahmen im Streckenabschnitt Wiesbaden bis Weiterstadt erfolgen. Bei der Abwicklung der Baustelle im Jahr 2021 kam es zu zahlreichen Störungen aus bahnbetrieblichen Gründen, u.a.: Erschwernisse durch eingeschaltete OL, Ausfallschichten wg. fehlendem Sicherungspersonal und aus signaltechnischen Gründen, Erschwernisse in den Nachtschichten wg. fehlender Gleissperrungen und Weichenstörungen, Ausfallschichten aufgrund abwesender BÜW 42, parallellaufende Baumaßnahmen, passierende Sonderzüge bzw. Zugverkehr und Abbruch von Schichten wg. Unwetter. Die sich aus diesen Störungseinflüssen ergebenen unproduktiven Einsatzzeiten sind Gegenstand des vorliegenden Nachtrages. Der BAU-AN ist mit der Ausführung der KTB-Leistungen für den genannten Bereich beauftragt. Bei der Ausführung sind aus diversen bahnbetrieblichen Gründen Einzelstörungen und Stillstandszeiten aufgetreten, welche nicht der BAU-AN zu vertreten hat. Die Leistung hätte somit auch nicht durch einen anderen BAU-AN in dem betroffenen Zeitraum ausgeführt werden können. Auch mit erheblichen Zusatzkosten wäre keine Ausführung möglich gewesen, auch durch keinen anderen BAU-AN.
