Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Infolge der Neuinstallation von Aufzügen zur barrierefreien Erschließung ist die Zuleitung für die Stromversorgung der Verkehrsstation Linz am Rhein nicht mehr ausreichend dimensioniert. Daher ist eine neue Zuleitung vom verbleibenden Stromanschluss her zu planen.

Es handelt sich um eine Erweiterung der durch den AN zu erstellenten Planung. Diese Planung der Stromzuleitung stellt einen direkten technischen Zusammenhang mit der Fa. Mailänder Consult GmbH dar und diese Erweiterungsplanung ist zwingend erforderlich. Eine Vergabe an einen anderen AN ist daher nicht möglich.
