Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der Auftragnehmer war mit der Erstellung des Bewetterungskonzeptes in der Planungsphase vertraut und hat die

Ausschreibung erstellt. Aufgrund der vorliegenden Fachexpertise ist ein Alleinstellungsmerkmal gegeben. Abweichungen des

Konzeptes des Bau AN von den Vorgaben werden in diesem arbeitsschutzrechtlich sensiblen Bereich bei der Prüfung eindeutig

erkannt. Eine Ausschreibung der zusätzlich zu erbringenden Leistung würde zu einer massiven Verzögerung im Projektverlauf

führen. Die fachliche Abnahme des Bewetterungskonzeptes ist Voraussetzung für die Bauausführung. Eine Verzögerung hätte

somit unmittelbare Auswirkung auf Vergabe, Bauausführung und Inbetriebnahme.
