Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Auf Grund der umfangreichen und deshalb sehr lange dauernden Planungsphase ergab sich der Sachverhalt, dass die zum

Zeitpunkt der Vertragsschließung vorliegenden KOSTRA Daten aktualisiert wurden. Dies hat zur Folge, dass hydraulische

Berechnungen unter Einbezug der neuen Niederschlagswerte, gemäß KOSTRA-Atlas 2020 Version 4.1 des DWD, neu

berechnet und überarbeitet werden müssen. Im Anschluss müssen die geplanten Kanalnetze auf Grundlage der

Berechnungsergebnisse überprüft werden. Die aktuellen KOSTRA Daten von 2020 müssen als neue Planungsgrundlage

berücksichtig werden und sind in die Planfeststellungsunterlage einzuarbeiten.

Dieser Sachverhalt war zum Zeitpunkt der Vertragsschließung im Jahr 2016 nicht absehbar, da die KOSTRA Daten erst nach

Vertragsschließung aktualisiert wurden und diese im Laufe des Planungsprozesses berücksichtigt werden müssen.
