Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Zusätzlicher Aufwand im Rahmen der Vorlauf- / und Einarbeitungszeit vom 02.11. – 31.12.2020 durch verspätet übergebene Unterlagen. Die Unterlagen wurden nur sukzessive, unvollständig und verspätet übergeben, was zu einer Verlängerung der Prüfdauer und Vorhaltung der Kapazitäten sowie einem größeren und mehrfachen Prüfaufwand geführt hat und die VE 97c die Vorlauf- und Einarbeitungszeit in den Monaten Jan. - April 21 erbringen musste. LÄ22

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

VE 97b konnte die Unterlagen an die VE 97c nur schleppend und sukkzessive übergeben.
