Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Zusätzlicher Aufwand bei der Betra- Bearbeitung aufgrund nicht vorhersehbarer zusätzlicher Sperrpausen und erhöhter Unterfristigkeit der Betra- Antragstellung. LÄ23

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Seit Übernahme der Bauüberwachungsleistungen müssen die Defizite in der Einhaltung der Prozesse gem. Ril 406 Baubetriebsplanung, Betra und La im Projekt durch zusätzliche Koordination, Besprechungen und Abstimmungen im Rahmen der Betra-Bearbeitung durch die Bauüberwachung kompensiert. Aufgrund fehlender Zuarbeit und mangelhaften Informationen, die die Grundlage für die Betra-Antragstellung bilden, verzögert sich die Antragstellung und führt neben der Unterfristigkeit von Anträgen zu Zurückweisungen bzw. Ablehnung des Antrages durch den Betra-Bearbeiter. Um den Baufortschritt sicherzustellen und die Antragstellung abzuschließen, entsteht ein erheblicher Koordinations- und Bearbeitungsmehraufwand.Darüber hinaus ist auch davon auszugehen, dass Betra-Anträge früher als gem. RIL beantragt werden mussten. Auch waren ca. 70 % mehr Anträge als laut Ausschreibung angedacht zu stellen, da viel mehr Sperrpausen zu berücksichtigen waren.
