Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Der AN hat hat bereits die bisherige Planung erstellt und ist somit auch am Besten dafür geeignet die Planung zu übernehmen. Daher ist es am effizientesten und technisch am sinnvollsten den bereits beauftragten AN die Planung durchführen zu lassen.

Ein neuer AN müsste erst in das Projekt, den Leistungsstand der Planung und den komplexen Planungsauftrag eingewiesen werden. Dies würde erhebliche Mehrkosten und Verzögerungen im Projektverlauf verursachen.
