Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Der dafür zuständige AN Bau konnte die PELIM-Messungen (Voraussetzung für IBN) nicht mehr rechtzeitig vor IBNfertigstellen. Die tachymetrische Engstellenmessung war vor Auftragsbeginn nicht vorhersehbar und konnten somit nich vomAN einkalkuliert werden
