    Die IKK classic gibt hiermit bekannt, dass sie mit allen interessierten und geeigneten pharmazeutischen Unternehmen im Zeitraum vom 01.11.2023 bis zum 31.10.2025 zu verschiedenen Wirkstoffen und Wirkstoffkombinationen nicht-exklusive Rabattvereinbarungen nach § 130a Abs. 8 SGB V zu gleichen, nicht verhandelbaren Bedingungen abschließen wird. Frühester Vertragsbeginn ist der 01.11.2023, sofern der unterschriebene Vertrag und alle nötigen Nachweise, Eigenerklärungen und Unterlagen bis zum 05.10.2023 bei der IKK classic eingehen. Danach gilt: Bei Eingang der Unterlagen bis zum 05. eines jeweiligen Monats im möglichen Beitrittszeitraum wird der jeweils 01. des Folgemonats Vertragsbeginn. Bei Eingang der Unterlagen nach dem 05. eines jeweiligen Monats im möglichen Beitrittszeitraum wird der jeweils 01. des übernächsten Folgemonats Vertragsbeginn. Ein Beitritt zur Vereinbarung ist im angegebenen Zeitraum jederzeit möglich, spätestens jedoch bis zum 05.09.2025. Weitere Angaben siehe Pkt. VI.3).

Treten zu einem der genannten Wirkstoffe exklusive Rabattvereinbarungen als Ergebnis eines europaweiten offenen Verfahrens im Zeitraum in Kraft, enden mit Start dieser die entsprechenden "open-house"-Verträge. In jedem Fall enden die Verträge zum 31.10.2025.

Die Bekanntgabe findet im Supplement zum Amtsblatt der Europäischen Union statt, um transparent und weiträumig über die Absichten der IKK classic zu informieren. Da für "open-house"-Verfahren kein entsprechendes Formular zur Verfügung steht, wird ersatzhalber das Formular für die Auftragsbekanntmachung offener Verfahren i.S. der Vergabekoordinationsrichtlinie (2014/24/EU) bzw. des Kartellvergaberechts genutzt. Hieraus ergibt sich keinerlei Unterwerfung unter vergaberechtliche Regelungen, soweit sie nicht aus rechtlichen Gründen verpflichtend sind.

Alle Unterlagen zu den Bedingungen der Rahmenvereinbarungen sowie Formulare zur Eigenerklärung werden den interessierten pharmazeutischen Unternehmen kostenfrei auf dem Portal der DTVP unter dem Link https://www.dtvp.de/Satellite/notice/CXP4Y7A6VKF/documents zur Verfügung gestellt. Zusätzlich zu den Eigenerklärungen muss ein Handelsregisterauszug vorgelegt werden, nicht älter als sechs Monate zum Vertragsbeginn.
