         Für die Versorgung der Abnahmestellen wird ein Strom nachgefragt, für den seitens der ausschreibenden Stelle keine Gestehungsvorgaben gemacht werden.

         Der Zuschlag wird auf das wirtschaftlichste Angebot erteilt, das den Bedingungen der Ausschreibung entspricht. Alleiniges Zuschlagskriterium ist der niedrigste Preis.

         Die Wertung bei dem vorliegendem Beschaffungsmodell erfolgt nach den Vorgaben der Nummer 10 der Leistungsbeschreibung.

         Sollte kein wirtschaftliches Angebot eingehen, wird die Ausschreibung aufgehoben. Kosten für die Bearbeitung der Angebote werden nicht erstattet.

         Aufgrund der Urteile des EuGH (EuGH, Urt. v. 19.12.2018 – C-216/17 – „Antitrust und Coopservice“) und EuGH, Urt. v. 17.06.2021 – Rs. C-23/20) wonach eine Rahmenvereinbarung bei Erreichen der Höchstgrenze ihre Wirkung verlieren soll (vgl. dazu auch OLG Koblenz, Beschl. v. 12.12.2022 – Verg 3/22) erfolgt folgende Festlegung (die zwar bei Energieausschreibungen keinen Sinn macht, von einigen Vergabekammern aber gefordert wird):

         Die Maximalmenge der beziehbaren Energie p.a. je Los beträgt 200% der als Referenzmenge je Los angegebenen Energiemenge (Referenzmenge) p.a..

         Der Bieter gibt einen Dienstleistungspreis getrennt für 2024 und 2025 ab. Dieser wird gewertet.

         • Die Energiebespreisung RLM findet nach Spotmarkt EEX Day-Ahead-Markt stündlich statt.

         • Bei RLM wird kein Toleranzband vereinbart.
