Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Gemäß Entwurfsplanung sollte die vorhandene Tiefenentwässerung zur Ableitung des anfallenden Oberflächenwassers genutzt werden. Im Zuge der Ausführung hat sich herausgestellt, dass die in der Entwurfsplanung geplante Anbindung der Streckenentwässerung ab km 65,1 an die Vorflut (vorhandene Streckenentwässerung ab km 65,1) nicht durchführbar ist. Die vorhandene Sammelleitung DN 400 unter den Gleisanlagen im Bereich des geplanten Gleises 113 ist an mehreren Stellen unterbrochen und kann somit nicht zur Ableitung des anfallenden Oberflächenwassers genutzt werden. Die neu geplante Tiefenentwässerung muss im Umkreis der bestehenden Speiseleitung errichtet werden. Um ein freies Baufeld und Arbeitssicherheit zu gewährleisten, muss die Speiseleitung für die Dauer der Arbeiten geerdet, gesichert, geprüft und abgeschaltet werden.

Diese Sachverhalte waren im Rahmen der Entwurfsplanung unvorhersehbar und konnten somit nicht im Hauptvertrag erfasst werden.
