Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Gegenstand der Vetragsabweichung ist die Planung sowie Baudurchführung einer Flachgründung für den Mast 13-9n. Aufgrund einer querenden Gasleitung im Bereich des Masts ist die ursprünglich geplante Bohrohrgründung nicht umsetzbar, weshalb eine Flachgründung erfolgen muss. Die Gründung des Masts 13-9n ist vertraglich vereinbart. Somit ist die Vertragsabweichung zur Erfüllung des ursprünglichen Vertrags notwendig.

Der Auftragnehmer ist bereits mit der Gründung der anderen Masten im Bauabschnitt beauftragt. Dementsprechend ist der AN während der Herstellung vor Ort, sodass die Erbringung dieser zusätzlichen Leistung durch den vorhandenen AN wirtschaftlicher ist. Die Einbindung eines weiteren Auftragnehmers führt demnach zu Mehrkosten sowie einem erhöhten Aufwand durch zusätzliche Schnittstellen.
