Es werden rund 51.000 Quadratmeter Gründungssohle hergestellt. Es werden rund 6.000 Meter Planumschutzschicht eingebaut. Es werden rund 2.000 Quadratmeter Asphaltschicht hergestellt. Es werden rund 7.600 Kubikmeter Entwässerungsanlage hergestellt. Es werden rund 32.000 Kubikmeter Boden entsorgt. Rund 6.700 Meter Planierarbeiten in Gleisen. Rund 14.000 Meter abladen von Bahnwagen. Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Im Rahmen der freigegebenen Ausführungsplanung sind Änderungen an der Lärmschutzwand LSW VII notwendig (stärkere

LSW-Gründungsrohre sowie Kleintierdurchlässe in den Sockelelementen), die nicht Bestandteil des Hauptvertrags-LV geworden

sind.

Der AN ist gemäß Hauptvertrags-LV umfänglich mit der Herstellung der Lärmschutzwand LSW VII(a+c) beauftragt. Die gemäß AP

erforderlichen Änderungen an den LSW-Sockelelementen bzw. der LSW-Gründung können von den bisher vereinbarten

Vertragsleistung kaum getrennt vergeben werden. Die Vergabe dieser zusätzlichen
