Auf der Strecke 6088 zwischen den Bahnhöfen Neubrandenburg und Demmin werden 2 Brücken, 3 Durchlässe und etwa 18 km Oberbau überwiegend komplett erneuert. Der Dreh- und Angelpunkt der Erneuerungsprojekte ist der Bahnhof Altentreptow in dem zusätzlich die gesamte Oberleitungsanlage erneuert wird. Die Umbaumaßnahmen werden größtenteils innerhalb einer festgelegten Sperrpause zwischen September und Dezember 2021 durchgeführt. Insgesamt sind die Bahngewerke konstruktiver Ingenieurbau, Oberbau, Oberleitung, 50 Hz, Leit- und Sicherungstechnik und Anpassungen an der Kommunikationstechnik betroffen.

Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

128: Gründung EÜ Datze. Es kam zu Verzögerungen während der Sperrzeit, weshalb die Spundwandgründung zu einem späteren Zeitpunkt fertiggestellt werden musste. Zusätzlich zu den Verzögerungen gab es eine Planabweichung im Bereich der Gründung.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die Verzögerungen während der Sperrpause im Frühjahr 2022sind auf drei unmittelbar aufeinander folgende Orkantiefs sowie unvorhergesehene Hindernisse im Baugrund zurückzuführen. Die Planabweichung in der Montage ist trotz prozesskonformem Prüflauf der Pläne nicht vorher erkannt worden. All diese Umstände waren vom Ag trotz seiner Sorgfaltspflicht nicht vorhersehbar.
