Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Der Wechsel des AN ist aus wirtschaftlichen Gründen nicht möglich:

Bei einem Wechsel wäre der Mängelanspruch gegenüber des ANs nicht mehr genau definierbar, da der AN einige der Materialien

wie vorgeschrieben auf der Baustelle zwischengelagerte. Zudem wurden Materialien von AN bereits bestellt, geliefert und auch im

Lagerraum eingelagert.

Ein Wechsel des AN ist mit erheblichen Schwierigkeiten oder Zusatzkosten verbunden:

Auch unter Berücksichtigung von Beschleunigungsmaßnahmen wäre die IBN der 50Hz-Anlagen gefährdet. Dies hätte erhebliche

Auswirkungen auf dem gesamten Masterplan und wäre mit beträchtlichen Verzögerungen und Zusatzkosten verbunden.
