Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

LÄA_03: Nach geplanter Rammrohgründung, wurden Suchschachtungen, um die neu geplante Gründungsart Monolith abzusichern.

Bei km 4,078 Sig. 4A musste, zur Klärung der in der Baugrube verlaufenden Kabel zum Signal, dieser Standort zurück gebaut werden.

Bei geplanter Gründung Schacht Gr. V bei km 4,230 und Nutzung der Bestandsrohre der bestehenden Gleisquerung wurde festgestellt, dass diese nicht nutzbar für weitere Kabelverlegearbeiten ist. Es muss eine neue zusätzliche Gleisquerung hergestellt werden. Die Bestandsrohre werden im neuen Schacht Gr. V mit eingebunden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund der unvorhersehbaren Unrammbarkeit des anstehenden Bodens (incl. Vorbohren und zweifacher Versuche), mussten Suchschachtungen zur Klärung der neuen Gründungsart durchgeführt werden. Da vorab nicht erkenntlich war, dass die vorhandene Kabelquerung bereits vollständig belegt war, war eine zusätzliche Kabelquerungsherstellung unumgänglich.
