Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Hauptvertrag ist die Bodenuntersuchung gemäß BBodSchV enthalten. Die Parameter MKW, BTEX und EOX sind im Parameterumfang gem. Anhang 2 Kap 4 der BBodSchV nicht ausdrücklich benannt. Da die Parameter baustellentypische Schadstoffparameter sind, ist eine zusätzliche Untersuchung im Sinne der Beweissicherung. Somit ist die Untersuchung der zusätzlichen Parameter zur regelkonformen Ausführung der Vertragsleistung erforderlich

Durch die im Hauptvertrag enthaltenen Leistungen ist der Auftragnehmer bereits mit der Beweissicherung gemäß BBodSchV beauftragt und beschäftigt. Bei der zusätzlichen Leistung handelt es sich um die Untersuchungen von zusätzlichen Parameter im Rahmen der ohnehin beauftragen Beweissicherung. Bei Vergabe der zusätzlichen Leistung an einen neuen Auftragnehmer müsste zunächst ein Teil der bereits beauftragten Leistung aus dem Hauptvertrag herausgekündigt werden, da die Probe bereits im Rahmen der Beweissicherung genommen und ins Labor geliefert wurde.
