Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Auf Grund der PT1-Änderungen (Baugleiseinrichtung) ist eine PT2 für die Bauphase 6.1, Baugleissicherung mittels Baugleissperre erforderlich.

Zur Vermeidung von Behinderungen und Stillständen (insbesondere bei den Folgearbeiten) wurde der AN mit diesen Leistungen beauftragt. Die Leistungen sind für die Umsetzung des Projektes erforderlich und damit auch, dass der AN seinen Werkerfolg, eine funktionsfähige und abnehmbare Anlage herzustellen, erbringen kann.

Folgenden Umständen wird durch die Anordnung der zusätzlichen Leistung als Nachtrag Rechnung getragen:

• Termine: Abhängigkeit der Gewerke untereinander und IBN in Gefahr

• Beträchtliche Zusatzkosten: Abhängigkeit der Gewerke untereinander und gestörter Bauablauf für den AN und für andere Gewerke und die Kosten, die durch eine neue Ausschreibung sowie der daraus entstehenden Folgekosten entstehen würden, übersteigen die angezeigten Mehrkosten.
