Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Im Zuge der Aufgefrierphase der Vereisung an den Querschlägen ist es infolge Eisdruck zu erheblichen Verformungen der

Tübbinge in den Haupttunnelröhren gekommen. Die Ursachen für die Verformungen sind technisch noch nicht abschließend

geklärt. Mögliche Abplatzungen und Risse in Folge der Verformungen müssen abschließend saniert werden. Es wird auf die

Risikoübernahme des AG gemäß Ergänzungsvereinbarung zur Sicherung des Bauablaufs Querschläge vom 22.12.2021 -

insb. §3, Abs 5 - verwiesen. Die Verantwortung für die mangelfreie Herstellung der Querschläge verbleibt bei der ARGE - die

zusätzlichen Maßnahmen sind in dem Zuge zu erbringen.
