Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Im Zuge der Baumaßnahme muss bei km 65,060 das Signal 02AA hergestellt werden. Im Rahmen der Ausführungsplanung

hat sich gemäß dem baubegleitendem Baugrundgutachten herausgestellt, dass eine Rammgründung für das Signal 02AA

gemäß HLV nicht umsetzbar ist. Aus diesem Grund war es erforderlich die Gründung als Monoblock-Fundament auszuführen,

woraus ein größerer Eingriffsbereich in die angrenzende Böschung resultierte. Eine Böschungssicherung (Winkelstützwand)

musste entsprechend ergänzend geplant werden. Gemäß Auflauge des geotechnischen Prüfers der Ausführungsplanung ging

hervor, dass eine Sicherung der darüberliegenden Böschung für die Herstellung der Stützwand ebenfalls zu gewährleisten ist

(Spritzbetonsicherung). Die Kombination aus Winkelstützwand und Spritzbetonwand ist aus wirtschaftlichen Gründen nicht

sinnvoll. Vor diesem Hintergrund war es notwendig die Böschung als vernagelte Spritzbetonschale zu planen und

auszuführen.

Diese zusätzlichen Leistungen in Bezug auf die Signalgründung haben sich im Rahmen der detaillierten

Ausführungsplanung ergeben, waren im Rahmen der Entwurfsplanung

nicht vorhersehbar und konnten im Hauptvertrag nicht berücksichtigt

werden.
