Kaufering befindet sich an der zweigleisigen Hauptstrecke 5520 München-Pasing – Buchloe. Es

münden die eingleisige Strecke 5363 aus Bobingen und die eingleisige Strecke 5364 aus Landsberg

am Lech in Kaufering ein. Es befindet sich im TEN-Kernnetz.

In Buchloe münden die Strecken aus Schwabmünchen und Kaufbeuren. Es befindet sich ebenfalls

im TEN-Kernnetz.

Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. 4 - Die Lage des Modulgebäudes hat sich im Laufe der Entwurfsplanung aufgrund einer Meinungsänderung der Stadt Kaufering trotz

großer Sorgfalt des Auftraggebers abgeändert. Es müssen Leistungen der Entwurfsplanung erneut angepasst werden. U.a.

Machbarkeitsstudien.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Mehrleistung seitens des AN beinhaltet aufgrund des Standortwechsels des Modulgebäude den Abgleich der Machbarkeit

des neuen Modulstandortes, die ergänzende Bestandsaufnahme für den Kabeltiefbau, die Durcharbeitung des Standortes des

Modulgebäudes (inkl. Zufahrt/Aufstellfläche und Entwässerungsanlage), Erstellen eines neuen Grunderwerbsplan und die

Anpassung der bereits erstellten Planung auf den neuen Standort. Aufgrund geringer Verfügbarkeiten am Markt als auch

bestehender Einarbeitung bei dem bestehenden AN, wäre bei einem wechselnden AN mit erheblichen Mehrkosten zu rechnen.
