Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Für den Bz 43N sind die Änderungen des D-Weges in die PT2 zu übernehmen. Die Weiche 135 ist mit einem Achszählkreis

einzuplanen und zur Weiche 132 ist der geplante AZ-Abschnitt in zwei AZ-Abschnitte aufzuteilen. Ausserdem ist in der Planung

eine Umbenennung eines LS-Signals vorzunehmen sowie die Anzahl der Tischfelder abzugleichen. Neuausschreibung hätte den

IBN Termin um Monate verschoben, was Vertragsstrafen in erheblicher Höhe nach sich gezogen hätte (Bereitstellung

Abstellanlage). Umbau SpDrS60 nur durch Siemens möglich (Systemvertrag). Der AN ist für die Planung, Lieferung und

Ausführung der Leistung zuständig. Daher kann aus Gewährleistungs- und Koordinationsgründen diese Leistung nur durch diesen

AN ausgeführt werden.
