Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist

fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2

GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der

Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist

kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Aufgrund einer Regelwerksanpassung (RIL 132) (16.01.2023) sind Veränderungen im "Rimini" vorgenommen worden (Auswahlprozess für Sicherungsmaßnahmen). Hierdurch wurde der Einsatz von Sicherungsposten weiter beschränkt, weshalb der Einsatz einer ATWS notwendig ist. Diese Regelewerksanpassung ist erst nach dem Zeitpunkt der Vergabe (09/2022) sowie dem Beginn der Arbeiten (10/2022) umgesetzt worden. Der Gesamtcharakter des Auftrages bleibt mit dieser Nachtragsleistung unverändert. Der AN führt die eingetakteten Sicherungsleistungen für die Baugrunderkundung durch. Bei dem Nachtrag handelt es sich um eine notwendige Anpassung der Sicherung.
