Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Zuge der Planung der EÜ Walter-Rathenau-Straße ist aufgrund der besonderen Umstände (Straßenabsenkung) eine dauerhafte Hebeanlage zur Grundwasserabsenkung im Bereich der Walter-Rathenau-Straße notwendig. Diese Leistung war im Hauptvertrag nicht vereinbart, und als zusätzliche Leistung aufzunehmen. Die Ausführung dieser Leistung durch einen dritten AN ist unwirtschaftlich und durch den Hauptauftragnehmer kostengünstiger zu erbringen, da dieser ohnehin die Planung der zugehörigen bautechnischen Anlagen ausführt. Die Ausführung dieser Leistung durch einen dritten AN ist planerisch nur mit hohem Aufwand in die Abläufe des Hauptauftragnehmers zu integrieren.
