Corona-Virus: Der Auftraggeber behält sich vor, wegen möglicher Undurchführbarkeit der hier ausgeschriebenen Leistungen wegen Einschränkungen aufgrund der Corona-Epidemie den Zuschlag nicht zu erteilen/das Vergabeverfahren aufzuheben bzw. einzustellen.

Hinweise des Auftraggebers zu Corona:

1. Die mit Erlass des BMI vom 23.03.2020, Ziff. II (BW I 7 – 70406/21#1, abrufbar unter https://www.bmi.bund.de/SharedDocs/downloads/DE/veroeffentlichungen/2020/corona/erlass-bauwesen-corona-20200323.pdf?__blob=publicationFile&v=1 herausgegebenen Hinweise zur Handhabung von Bauablaufstörungen werden auf den abzuschließenden Vertrag entsprechend angewendet. Die dortigen Aussagen zum Umgang mit und Nachweis von Höherer Gewalt macht der Auftraggeber sich zu eigen.

2. Angebote müssen weiterhin verbindlich sein und den Vergabeunterlagen entsprechen. Von den Vergabeunterlagen abweichende Angebote oder Angebote mit Vorbehalten, z. B. bei Terminen, müssen ausgeschlossen werden. Von entsprechenden Erklärungen bitten wir daher abzusehen.

Ab dem 19.04.2017 ist bei Vergaben gemäß SektVO sowie größer 50.000 Euro nur noch die Übermittlung von Angeboten/Teilnahmeanträgen über das Vergabeportal der Deutschen Bahn AG zulässig.

Mit Abgabe des Teilnahmeantrages ist die unterschriebene Vertraulichkeitserklärung (Dokument 20FEI48063 Anlage 21 Vertraulichkeitsvereinbarung) des Projektes einzureichen.

Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im laufenden Prozess zeigte sich, dass für die Erstellung der Bewertungsmatrix weitere über die Kriterien der Sensi/Variante11 hinaus betrachtet werden mussten und diese in vielen Arbeitsschritten und wiederkehrend nach Betrachtung desGesamtvorhabens anzupassen sind.Es waren mehrfache im Hauptvertrag nicht kalkulierte Abstimmungsprozesse mit den Umweltplanern der Nachbarabschnitteerforderlich. Darüber hinaus waren Neubewertungen von diversen Schutzkriterien aufgrund nachträglich erfasster Baugebieteerforderlich.Durch die Ausführung der geforderten außervertraglichen Leistung entstehen Mehrkosten gegenüber der bisher vertraglichvereinbarten Vergütung.
