Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

MKA167: Liefern und montieren Tiefenerder und Trennstellkasten für das ESTW Wirtheim, Langenselbold und Gelnhausen

Entsprechend Blitzschutzkonzept müssen jeweils an 4 Ecken der ESTW Modulgebäude ein zusätzlicher Tiefenerder für die Ableitung des Blitzstromes installiert werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Durch den AN wurden die Außenanlagen inkl. Abwasserrohre und Drainagerohre rund um die ESTW Modulgebäude errichtet. Der AN hat die Gewährleistung für die errichtete Außenanlage. Aus diesem Grund muss die Nachrüstung der Tiefenerder durch den AN erfolgen. Die Einbindung eines weiteren AN zur Herstellung der Tiefenerder ist nicht möglich, da zum Zeitpunkt der Ausführung noch keine validierten Bestandspläne der neuen Außenanlage vorliegen. Somit hat nur der Ersteller der Außenanlage die Kenntnis über die im Boden verlegten Trassen und Rohre und ist damit allein in der Lage sicher kollisionsfrei die Tiefenerder einzubringen.
