Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Für die Verlegung zus. gefundenen Bestandskabel muss ein Kabelkanal Gr. III an der Bahnsteighinterkannte des Bstg. 1 gebaut werden. Diese zus. Leistungen werden für die Fertigstellung des Bau-Soll benötigt. Da die Fa. Strabag bereits mit dem Umbau der Bahnsteige beauftragt wurde, sind die Mehrmengen und zus. Leistungen, die im Rahmen der Baumaßnahme entstanden sind an Fa. Strabag zu vergeben.

Außerdem bestehen Synergieeffekte dadurch, dass die Fa. Strabag sich bereits im Baufeld befindet, ihre BE-Fläche eingerichtet hat und die notwendigen Bautruppen disponiert hat. Die Beauftragung eines zus. Bau ANs wäre ebenfalls zeitlich nicht möglich gewesen. Darüber hinaus verursacht die Koordinierung von mehreren Baufirmen zus. Aufwand (Schnittstelle BE-Fläche, Bauablauf, usw.).
