Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
Die zusätzliche Leistung wird erforderlich, da zum Zeitpunkt der Teil-Inbetriebnahme die Heizungs- und Kälteanlagen technisch und vertragsrechtlich nicht abgenommen und somit an den Betreiber übergeben werden können. Zur Vermeidung einer konkludenten Abnahme erfolgt das Betreiben und Bedienen der Heizungs- und Kälteanlagen bis zur Übergabe der gesamten Leistung an den Betreiber eigenverantwortlich durch den mit der Erstellung der Heizungs- und Kälteanlagen beauftragten Bau-AN.
Eine Vergabe eines direkten Auftrags an den Bau-AN Heizungs- und Kälteanlagen ist aus diesem Grund nach §132 Abs. 2 Nr. 2 auch ohne Durchführung eines Vergabeverfahrens zulässig.
