Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Beauftragung eines weiteren Planungsbüros ist aufgrund des Beauftragungsumfangs des Haptvertrages von Weihermüller

& Vogel nicht sinnvoll. Durch die bereits erbrachten Vorleistungen können Synergieeffekte genutzt werden, welche durch ein neu

zu beauftragendes Planungsbüro nicht gegeben sind. Es würden Wiederholungsleistungen, bei den bereits gebundenen

Fachplanern als auch bei dem zu beauftragenden Planungsbüro anfallen, welche durch die Beauftragung von Weihermüller und

Vogel vermieden werden. Zudem ist die Einhaltung des eng getakteten und mit dem Land Hessen vereinbarten Terminplans bei

Beauftragung eines weiteren Büros stark gefährdet. Aus den genannten Gründen empfiehlt sich eine Beauftragung von

Weihermüller & Vogel zur Objekt- und Tragwerksplanung der zusätzlich notwendigen Stützwände.
