Das deutsche Vergaberecht regelt die Frist für die Einlegung von Rechtsbehelfen in § 160 Abs.3 GWB und § 135 Abs. 1 Nr. 2 und Abs 2 GWB. Genaue Angaben zu den Fristen für die Einlegung von Rechtsbehelfen: Dort heißt es: „Der Antrag ist unzulässig, soweit:

1) der Antragsteller den gerügten Verstoß gegen Vergabevorschriften im Vergabeverfahren erkannt und gegenüber dem Auftraggeber nicht innerhalb einer Frist von 10 Kalendertagen gerügt hat,

2) Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, nicht spätestens bis Ablauf der in der Bekanntmachung benannten Frist zur Angebotsabgabe oder zur Bewerbung gegenüber dem Auftraggeber gerügt werden,

3) Verstöße gegen Vergabevorschriften, die erst in den Vergabeunterlagen erkennbar sind, nicht spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Angebotsabgabe oder zur Bewerbung gegenüber dem Auftraggeber gerügt werden,

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Notwendigkeit der Vertragsverlängerung ergibt sich daraus, dass erst im Sommer 2023 das neue Bettenhaus in Betrieb genommen wird. Die Inbetriebnahme wurde aufgrund von Bauverzögerungen mehrfach verschoben. Die Vertragsverlängerung ist derzeit die einzige Möglichkeit, die Abfallentsorgung weiterhin sicherzustellen. Das bestehende Entsorgungs- und Logistikkonzept bedarf einer wesentlichen Neukonzeptionierung. Diese kann jedoch erst mit Echtbetrieb erfolgen. Die Neukonzeptionierung des Entsorgungs- und Logistikkonzeptes ist Bedarfsgrundlage und wesentliche Voraussetzung für die Neuausschreibung der Abfallentsorgungsleistungen. Ein Wechsel des Auftragnehmers ist aus wirtschaftlichen Gründen nicht möglich. Zum anderen kann die Organisation derzeit einen Auftragnehmerwechsel ohne wesentlichen Eingriff in den laufenden Betrieb nicht umsetzen. Die Vorlaufzeit bzw. Projektierung für einen Dienstleisterwechsel bedarf mehrerer Monate.
