Anpassung der "Allg. Fixkosten" sowie der "Allg. Fixkosten je Fahrzeug" im Verlängerungs-Schuljahr 2023/2024, für die im Vertrag keine Anpassungsklausel enthalten war.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Neben den Preisbestandteilen „Kraftstoff“ und „Personalkosten“, für die in den Vergabeunterlagen ein Preisfortschreibungsmechanismus enthalten war, bedürfen auch die Preisbestandteile „Allg. Fixkosten“ sowie „Allg. Fixkosten je Fahrzeug“, die ursprünglich nicht für eine Anpassung vorgesehen waren, nunmehr einer Preisanpassung.

Diese war im Hinblick auf die eingetretenen massiven kostensteigernden globalen Ereignisse nicht vorhersehbar (Pandemiegeschehen/Lieferketten/Russlands Angriffskrieg gegen die Ukraine) und sind für die Durchführung einer auskömmlichen Dienstleistung zu erhöhen.
