Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der AN ist im Rahmen des Hauptvertrags mit der Planung des Projekts "ETSW Grobau" beauftragt. Im Rahmen der Erstellung der Genehmigungsplanung wurden die Anpassungen der Umweltplanung hinsichtlich neu veröffentlichten Regelwerk erforderlich. Außerdem wurden zusätzliche Mehrexemplare gegenüber der vertraglichen Vereinbarung vom EBA gefordert.

Die zusätzliche Leistung steht in direktem zeitlichen und planerischen Zusammenhang mit dem geschuldeten Leistungssoll des AN. Durch einen zusätzlichen AN im Planungsbereich sind Überschneidungen und Verzögerungen im Projektverlauf aufgrund des Ineinandergreifen der Leistungen möglich.
