Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Zuge der vertragliche geschuldeten Verkehrsanlagenplanung muss die Stützwand 1 im Bereich des ÜBW zwischen denRichtungsgleisen der Strecken 5600 und 5601 neu errichtet werden. Die Planung von dieser Stützwand ist nicht Gegenstand des Hauptvertrages und nicht Bestandteil bereits beauftragter zusätzlicher Leistungen. Die Planung dieser Stützwand ist für die Fertigstllung der GP bzw. EP erforderlich. Zur Umsetzung einer inhaltlich zusammenenhängenden Planung muss die Stützwand 1 vom AN geplant werden. Die Planung der Stützwand 1 erfolgt in direktem Zusammenhang mit der Verkehrsanlagenplanung und ist technisch nicht sinnvoll trennbar. Darüber hinaus ist der AN mit den Schnittstellen zu tangierenden Planungen und betroffenen Gewerken bestens vertraut. Eine gesonderte Vergabe wäre mit Zusatzkosten hinsichtlich Koordination durch den AN Planung und des AG bzw. eines weiteren AN verbunden. Eine Abwicklung durch den AN ist daher für die Planungsqualität zwingend erforderllich.
