Precise information on deadline(s) for review procedures:

Mit der Abgabe eines Angebotes unterliegt der Bieter/die Bieterin den Bestimmungen über nicht berücksichtigte Angebote gemäß § 19 EU VOB/A.

Vergaberechtsverstöße sind vom Antragsteller eines Nachprüfungs- verfahrens vor der Vergabekammergegenüber der Vergabestelle zu rügen. Ansonsten gilt gemäß § 160 Absatz 3 GWB, dass ein Nachprüfungsantrag unzulässig ist, soweit.

1. der Antragsteller den geltend gemachten Verstoß gegen Vergabevorschriften vor Einreichen des Nachprüfungsantrags erkannt und gegenüber dem Auftraggeber nicht innerhalb einer Frist von zehn Kalendertagen gerügt hat; der Ablauf der Frist nach § 134 Absatz 2 GWB bleibt unberührt,

2. Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, nicht spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Bewerbung oder zur Angebotsabgabegegen über dem Auftraggeber gerügt werden,

3. Verstöße gegen Vergabevorschriften, die erst in den Vergabeunterlagen erkennbar sind, nicht spätestens bis zum Ablauf der Frist zur Bewerbung oder zur Angebotsabgabe gegenüber dem Auftraggeber gerügt werden,

4. mehr als 15 Kalendertage nach Eingang der Mitteilung des Auftraggebers, einer Rüge nicht abhelfen zu wollen, vergangen sind.

§ 160 Absatz 3 Satz 1 GWB gilt nicht bei einem Antrag auf Feststellung der Unwirksamkeit des Vertrags nach§135 Absatz 1 Nummer 2 GWB. § 134 Absatz 1 Satz 2 GWB bleibt unberührt.

VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Gemäß § 132 Abs. 2 Nr. 3 GWB ist eine Änderung eines öffentlichen Auftrags ohne Durchführung eines neuen Vergabeverfahrens zulässig, wenn die Änderung aufgrund von Umständen erforderlich geworden ist, die der öffentliche Auftraggeber im Rahmen seiner Sorgfaltspflicht nicht vorhersehen konnte, und sich aufgrund der Änderung der Gesamtcharakter des Auftrags nicht verändert.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Es wurden insgesamt drei Auftragsänderungen zum ursprünglichen Los 35 Malerarbeiten erforderlich.

Nachtrag 1:

Aufgrund einer Verträglichkeitsprüfung des Untergrundes der bauzeitlichen Putze mit Anstrichen, wurde diese Änderung erforderlich. - Altanstriche entfernen

Wert ohne MwSt.: 6.969,50 EUR

Nachtrag 2:

Diese Änderungen wurden aufgrund der Vorgaben aus dem Brandschutznachweis erforderlich.

Die Änderung umfasst folgende Arbeiten: Teer- bzw. Bitumenstreifen an Wänden entfernen und entsprechend Anwendungstechnik Firma Keim nach örtlicher Befundlage überarbeiten, GK-Wände putzen, Stahlträger R30 Überarbeiten, Überarbeitung nach Anlegen von Farbmusterflächen erforderlich.

Wert ohne MwSt.: 10.332,37 EUR

Nachtrag 3:

Änderung der Konstruktion infolge Lieferschwierigkeiten und Wechsel des Auftragnehmers Los 20 Rohbau.

Diese Änderung umfasst den Anbau eines WDVS.

Wert ohne MwSt.: 15.802,47 EUR
