Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

m Rahmen der Vorplanung zur EÜ Bornaer Str. km 56,931 wurde ermittelt, dass entlang der Bornaer Straße zur Abfangung von privaten Grundstücken eine Stützwand errichtet werden muss. Diese Stützwand ist zum einen Teil projektveranlasst und im Kreuzungsbereich der EÜ, zum anderen Teil aber der Straßenerweitung der Stadt Chemnitz geschuldet. Diese Stützwand ist als Objekt nicht Bestandteil des Hauptvertrages und somit als erweiterte Planungsleistung zu sehen. Weiterhin wurden im Rahmen der Entwurfsplanung Leistungen Dritter (Kanalbefahrung, Luftbildauswertung, Vermessung) erforderlich die zeitlich dringlich beauftragt und abgearbeitet werden mussten, um die ohnehin zeitkritische Terminschiene nicht weiter zu belasten. Für diese Leistungen mussten die Aufgabenstellungen und erforderlichen Vorgaben durch den AN formuliert werden. Dafür sind zusätzliche Leistungen angefallen.

Die ARGE GRE - Schulze&Rank ist für die EÜ Bornaer Straße bereits mit der Erstellung der Grundlagenermittlung und Vorplanung (Lph.1-2) sowie Entwurfsplanung und Genehmigungsplanung (Lph 3-4) beauftragt. Planunterlagen und Dokumente dieser Vorplanung und Entwurfsplanung sind Grundlage und Voraussetzung für die Beplanung des zusätzlichen Objektes Stützwand. Weiterhin hat der AN die Projektkenntnis um für Dritte an der Planung Beteiligte einzuweisen und die entsprechende Planungsaufgabe für Ihren Bereich zu formulieren. Ein weiterer AN führt zu einem unwirtschaftlichen Mehr- und Koordinierungsaufwand. Eine Trennung der Leistungen ist nicht möglich, da die Erstellung der zusätzlichen Planung des Objektes Stüwa und die Koordination der Planungaufgaben für die Dritten auf Leistungen bzw. Planungen und auch Kenntnissen der Leistungsphase 1,2 und 3 der ARGE aufsetzt. Mit AN-Wechsel kommt es zu signifikanten Verzögerungen im Zeitplan und es stehen sich die gesonderte Wertung und Vertragsabwicklung des neuen AN, mit einem unverhältnismäßigen zusätzlichen Aufwand, im Vergleich zur Gesamtleistung der ARGE GRE - Schulze&Rank gegenüber (unwirtschaftliche Splitterung).
