Es werden rund 7.600 Kubikmeter Entwässerungsanlage hergestellt. Es werden rund 6.400 Meter Sickerleitung hergestellt. Es werden rund 33.000 Kubikmeter Boden entsorgt. Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

In verschiedenen Abschnitten des vertraglichen Planungsabschnitts 1.2 sind auf Grundlage der vorgegebenen Trassierung Überschreitungen der Regelgleisabstände erforderlich. Somit sind in diesen Bereichen größere Planumsbreiten herzustellen, welche so nicht Bestandteil des Hauptvertrages sind und somit als geänderte Leistung gegeüber dem vertraglichen Bausoll gewertet werden müssen. Gemäß Hauptvertrag waren Breiten von 5,00 - 5,50 m vereinbart. Gemäß Ril 800.0130 sind im Gleisbereich jedoch Gesamtbreiten der PSS von 6,60 bis 7,00 m und im Weichenbereich von 7,60 bis 10,0 m notwendig.

Der AN ist mit dem Einbau der PSS beautragt, es müssen lediglich veränderte Breiten hergestellt werden. Der Gesamtcharakter des Auftrages des AN ist unverändert. Eine Trennung der zusätzlichen Breiten von den durch den AN auzuführenden Leistungen ist nicht möglich. Zudem ist der Einbau der PSS eng verzahnt mit den übrigen auszuführenden Leistungen und daher nur unter hohen Aufwänden von diesen trennbar.
