Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

a) Im Hp. Jeßnitz sollten Flächen für den Umschlag von Material durch den AG zur Verfügung gestellt werden. Auf Grund einer Bauverzögerung ( Abriß Empfangsgebäude ) standen diese Flächen zum erforderlichen Zeitpunkt nicht zur Verfügung. Dadurch musste eine zusätzliche Zwischenlagerfläche hergestellt werden.

b) Die Herstellung von BE- Flächen ist Bestandteil des Vertrages und somit geschuldetes Bau-Soll. Im vorliegenden Fall musste die BE - Fläche erweitert werden.
